1. Acceptance of terms
These Terms of Use (“Terms”) govern access to and use of the SMSGo platform — including the API, web dashboard, and related services (the “Service”) — operated by Oryn Labs, LLC (“we”, “our”). By creating an account, accessing, or using the Service, you (“Customer”, “you”) acknowledge that you have read, understood, and fully accepted these Terms. If you do not agree, do not use the Service.
2. Service description
SMSGo provides infrastructure for sending SMS messages — bulk sends, verification codes (OTP), and transactional alerts — as well as number validation, contact and list management, and delivery reports. The Service is billed by credits consumed, with no monthly fee.
3. Registration and account
- You must provide truthful, complete, and current registration information.
- You are responsible for keeping your credentials and API tokens confidential.
- You are responsible for all activity performed through your account or token.
- You must be at least 18 years old and legally able to enter into a contract.
4. Acceptable use
When using the Service, you agree not to:
- Send messages without the recipients’ prior, valid consent (opt-in);
- Send illegal, fraudulent, defamatory, spam, or phishing content;
- Send messages outside the hours permitted by applicable law;
- Circumvent opt-out mechanisms or ignore do-not-contact requests;
- Attempt to access, overload, or compromise the Service infrastructure.
Message delivery must comply with carrier rules and Brazilian telecommunications regulations. Noncompliance may result in immediate account suspension.
5. Credits and payments
- Credits are purchased in advance and debited according to usage.
- The applicable prices are those displayed on the platform at the time of purchase.
- Sent messages are billed regardless of the final delivery status reported by the carrier.
- Except where otherwise required by law, purchased credits are nonrefundable.
6. Availability and support
We strive to maintain high Service availability but do not guarantee uninterrupted operation. Scheduled maintenance, carrier failures, or force majeure events may affect delivery. Support is available at contato@SMSGo.io.
7. Intellectual property
The Service, its brand, code, documentation, and materials belong to Oryn Labs, LLC. These Terms do not transfer any intellectual property rights to you beyond a limited, revocable license to use the Service.
8. Limitation of liability
The Service is provided “as is”. To the fullest extent permitted by law, Oryn Labs, LLC is not liable for indirect damages, lost profits, or delivery failures attributable to carriers, third parties, or misuse of the Service. Our total liability is limited to the amount you paid during the 12 months preceding the event.
9. Suspension and termination
We may suspend or terminate access, with or without notice, for violation of these Terms, misuse, nonpayment, or legal requirements. You may close your account at any time from the dashboard (My Account > Security > Delete account), subject to password confirmation.
When the account is closed, your personal data will be anonymized. Financial records (invoices and transactions) will be retained in anonymized form for five years as required for tax purposes. For details, see our Privacy Policy.
10. Changes
We may update these Terms periodically. Material changes will be communicated through the dashboard or by email. Continued use after the new version takes effect constitutes acceptance.
11. Governing law and venue
These Terms are governed by the laws of the Federative Republic of Brazil. Where applicable, disputes will be submitted to the courts of the Customer’s domicile.
